Rights and guarantees of FEZ

Subjects of free economic zone – foreign and domestic investors, making financial and material contribution to the economic sphere and other activities of free economic zone, have the right:

– creation of joint organisations with participation of foreign and domestic investors;

– on the basis of the contract he/she carries out economic activity, freely chooses a partner, the subject of the contract, determines obligations, as well as other conditions of economic relations;

– independently carry out foreign economic activity, barter and intermediary operations, as well as reinvestment within the free economic zone, if the nature of these operations does not violate the law and does not threaten the economic security of the state; Republic of Tajikistan;

– take loans from banks, companies and foreign organisations without restrictions, attract foreign insurance organisations to conclude all kinds of insurance operations;

– any investments in the free economic zone not prohibited by the legislation of the Republic of Tajikistan;

– use of a land plot on the basis of a lease agreement for the term of property, property rights and transfer of the right of use with the consent of the parties to the lease agreement or their heirs, as well as other property and non-property rights;

– foreign citizens and citizens of the Republic of Tajikistan are hired on the basis of a contract;

– to carry out other activities not prohibited by the current legislation of the Republic of Tajikistan, to own, use and dispose of the results of their investment, including reinvestment and commercial operations on the territory of the Republic of Tajikistan;

– export profit or its part in the form of products of own production or bought on the market;

– transfer abroad after payment of compulsory duties of monetary funds received by them in the form of profit, as well as in connection with the sale of the entire share in the charter capital of the organisation with foreign capital, withdrawal of monetary funds from it or liquidation of the organisation;

– right to transfer, deliver, pledge and terminate their investments in FEZ.

Guarantees to FEZ subject

– FEZ guarantees (according to the legislation of the Republic of Tajikistan and international law):

– legal protection of investments;

– protection of FEZ subjects’ copyrights;

– equality of legal system of foreign and domestic investments;

– prevention of any discrimination against organisations with foreign capital.
